In a significant legal development just weeks before the start of the NFL season, a U.S. judge has temporarily blocked the launch of a new sports streaming service, Venu, which is jointly owned by Disney, Fox, and Warner Bros. Discovery. The injunction, granted in response to an antitrust lawsuit filed by Fubo TV, has cast uncertainty over the planned debut of the service, which was scheduled to coincide with the start of one of the most lucrative sports seasons in the U.S.
Fubo TV, an internet TV bundle service that provides a range of sports channels, argued that the launch of Venu would be anticompetitive and could significantly harm its business. According to Fubo, Venu’s entry into the market would disrupt the competitive landscape by offering exclusive sports content controlled by some of the largest media conglomerates in the country. This, Fubo claimed, would limit consumer choice and potentially drive smaller competitors out of the market.
Venu’s Controversial Market Entry
Venu, a joint venture announced earlier this year by Disney’s ESPN, Warner Bros. Discovery, and Fox, was poised to offer a comprehensive package of live sports, including rights to major leagues such as the NBA, NFL, NHL, and MLB. The service, priced at $42.99 per month, would also provide access to 14 traditional TV sports networks from its parent companies, including ESPN, ABC, Fox, TNT, and TBS, along with the ESPN+ streaming service.

Critics, including Fubo TV, DirecTV, and Dish Network, argued during a multi-day hearing that Venu’s launch would give its parent companies an unfair advantage in the marketplace. By controlling approximately 54% of all U.S. sports rights, the media giants could potentially dominate the sports streaming market, pushing smaller players out of the competition. U.S. District Judge Margaret Garrett, who presided over the case, highlighted the considerable market power held by Disney, Fox, and Warner Bros. Discovery, noting that together they could wield significant influence over sports licensing and distribution.
Reactions from the Industry
The court’s decision has been hailed as a victory by Fubo TV and other smaller competitors, who view the ruling as a crucial step in maintaining a competitive streaming landscape. Fubo TV’s CEO, David Gandler, expressed satisfaction with the outcome, stating that the decision ensures consumers will continue to have access to multiple sports streaming options rather than being forced into a monopoly-like situation.
“This ruling is a victory not only for Fubo but also for consumers. This decision will help ensure that consumers have access to a more competitive marketplace with multiple sports streaming options,” Gandler said in a press release following the court’s decision.
Echoing these sentiments, DirecTV and Dish Network also praised the injunction, emphasizing that it protects the integrity of the video marketplace by preventing major content creators from favoring their affiliated platforms over independent services. Jeff Blum, Executive Vice President of Government and External Affairs at EchoStar, described the ruling as a critical measure to prevent anticompetitive practices that could harm both consumers and smaller service providers.
Ongoing Legal Battle
Despite the temporary injunction, the legal battle is far from over. Disney, Warner Bros. Discovery, and Fox have expressed their disagreement with the court’s decision and have announced plans to appeal. In a joint statement, the companies asserted that Fubo’s allegations are unfounded and that the proposed service would enhance, not hinder, consumer choice by offering sports content to audiences who are currently underserved by existing streaming options.
“We respectfully disagree with the court’s ruling and are appealing it,” the joint statement read. “We believe that Fubo’s arguments are wrong on the facts and the law, and that Fubo has failed to prove it is legally entitled to a preliminary injunction. Venu Sports is a pro-competitive option that aims to enhance consumer choice by reaching a segment of viewers who currently are not served by existing subscription options.”
